Indian Family Times - News Letter

New Delhi: A monthly newsletter — Indian Family Times — that has taken up a fight against the anti-dowry law on the internet, has invited contributors to post pictures and profiles of women who have “misused” the law to lodge false dowry cases against men. 

   The online newsletter, started this month, has also hailed Delhi Police commissioner Y S Dadwal as a “true patriot” while calling women and child development minister Renuka Choudhary a “pinhead”. 

   Terming IPC 498A or the anti-dowry law as “legal terrorism” — that was introduced with good intentions but has been plagued by bad execution — the newsletter claims that it will highlight the harrowing tales of victims who have fallen prey to the misuse. 

   This comes close on the heels of a consultation by the WCD ministry on the issue following criticism against the Dowry Prohibition Act and the Domestic Violence Act. 

   ”The law is being used by unethical and immoral women and their families to harass the husband’s family, humiliate them to accept their improper and illegal demands, and extort money,” the newsletter said. The e-zine has a “hall of shame” that includes a woman’s name, address, educational qualifications and her family details warning prospective “grooms” to keep away. Its “success story” has details of a man who has been successful in escaping the “trap”. 

   The publication lauds Dadwal for issuing standing instructions that no arrests except for the husband’s be made in 498A cases without the permission of the DCP. Referring to WCD minister Renuka Choudhary, the newsletter says that “for her actions against the Indian family and her crazy comments, Ms Choudhary is a pinhead”. 

   Reacting sharply to the remarks, Choudhary said, “This is classic male behaviour. I really pity these men… this is no way to change the system.” Referring to the newsletter’s move to include women’s profiles and pictures, Choudhary added, “It is a democracy and they are free to do what they want but it is an unfortunate thing that they want to put up women’s pictures like this. Do we have to upload pictures of dead wives and sisters to make our point?”

Letter to Frontline Editor

Dear editor,

I, Uma Challa, President, All India Forgotten Women, am compelled to write this letter in response to the article entitled “The real victim” by T.K. Rajalakshmi.

The article is replete with misrepresented facts and misleading
statements. To top it all, the author ends the article by saying, “the
campaigns against the misuse of the law has to have some substantive
basis, but at least for now, there does not seem to be any.”

Such irresponsible statements can only be made due to utter ignorance
or ulterior motives. I present below, important facts that explain why
MEN AND WOMEN are fighting against weapons of legal terrorism like IPC
Section 498A (refer to the picture of Save Indian Family Foundation
protest published in the article).

Indian “women-protection laws”, which are in essence wife-protection
laws, assume that wives are always honest victims and therefore
require no proof of their claims before initiating action against the
accused. The draconian law, IPC Section 498A, in particular, allows
arrest of the husband and his relatives solely on the basis of the
complaint of a wife, without any proof or investigation. Further, the
accused are assumed to be guilty until proven innocent.

Added to these blind assumptions, lack of punishment or penalty for
misuse of the law has made IPC Section 498A a dangerous weapon in the
hands of unscrupulous wives to harass husbands along with elders and
women in the matrimonial home. Consequently, every five minutes an
innocent person is arrested under IPC Section 498A. Several sources
indicate that 98% of cases under IPC Section 498A are filed only to
settle personal scores when there is martial discord.

Every year 30,000 innocent women are arrested (i.e. one innocent woman
every 20 minutes) under IPC Section 498A. Everyday, minor girls,
pregnant women, married and unmarried sisters, ailing mothers and even
aged grandmothers are being sent behind bars and prosecuted based on
mere allegations. Unmarried women have ended their lives unable to
bear the humiliation of being arrested and rejected by prospective
alliances. Lives of married women are adversely affected as well due
to the unbearable stress caused by false prosecution for 7-10 years.

Every year, close to 4,000 innocent senior citizens are arrested (i.e.
one innocent elderly person every 2.5 hours) under IPC Section 498A.
Many retired elders have been ill-treated, thrown out of their own
homes and deprived of their meagre means of sustenance by greedy or
vengeful daughters-in-law. Senior citizens are further harassed
through false cases of domestic abuse and dowry harassment and denied
mental peace during the last leg of their lives. Aged parents have to
helplessly watch their sons lose their youth, their health, their
jobs, all their earnings, and sometimes even their lives, as they are
mercilessly tortured by their estranged wives, aided by advocates, the
Police and the Judiciary. More and more elderly parents are unable to
depend on their sons for the fear of false dowry harassment cases by
resentful daughters-in-law. It is not surprising that the World Health
Organization, in its report on India cited IPC Section 498A as one of
the major reasons for the “Increasing Abuse of the Elderly in India”.

Children are not being spared from the suffering either. Irrespective
of the reasons for marital discord, wives are filing criminal cases of
domestic abuse and dowry harassment to deny children access to their
fathers, causing great pain to the fathers and children. Children are
also being arrested under false charges of dowry harassment, and
imprisoned along with older family members. In other cases, children
are being torn apart from their parents who are hauled away by the
police in front of their eyes, causing indelible scars and fears in
their young minds.

Falsely accused men have to fight the highly corrupt state machinery
on behalf of the women, children and the elderly in their families, at
their own personal expense, all the while carrying the presumption of
guilt on their heads. Many young men lose their employment either
because they are forced to appear in court frequently, or they must
often travel to a different city or state to fight their cases, or
because they are unable to focus on their professions while fighting
the cases.

Where would these men gather the strength and the resources needed to
fight the corruption and public prosecution effectively? If the
accused men are already indigent and cannot afford the best defense
money can buy, their fate is sealed. Many men who are threatened or
accused under false cases end their lives like Abdul Rahim of
Karimnagar, Rajesh Hasmukh Desai of Ahmedabad or Pushkar Singh of
Lucknow. In some cases, they end up taking the lives of their spouses
before ending their own lives as was seen in the more recent case of
Amit Budhiraj.

It is clear that the so-called “women-protection laws” are only
destroying families and creating havoc in the society. It is these
sufferings of men, women and children that form the basis for our
campaign against draconian laws like IPC Section 498A. However,
radical feminists, from organizations like AIDWA and NCW, behave like
the proverbial ostrich, keep churning out false statistics and spread
lies, paranoia and alarmism to justify the existence of the
organizations and to attract international funding to sponsor legal
terrorism.

Radical feminists are desperately trying to draw attention away from
the reasonable amendments that organizations like All India Forgotten
Women recommend in the interest of justice, fairness and true gender
equality.

By publishing biased articles like “The real victim”, Frontline is
doing huge disservice to the society. It would behoove Frontline to
publish an unbiased article correcting the misrepresented facts and
misleading statements in the article authored by T.K. Rajalakshmi.

Protest in Bangalore on Father’s Day - 14th June

It takes two to make a relation and the most beautiful outcome of any relationship is our children. Beautiful, innocent, full of life, sweet, charming and hordes of other adjectives can be ascribed to them. But irony seems to have devoured even this aspect of life. Children of late have become a tool to obtain, maintain, and sustain supremacy and ego feeding in relationships. Whenever a relationship worsens, a tussle starts between the warring errant couples to get a good scorecard from their children and try to retain them. Many a times they are used as a blackmailing weapon. Men are threatened of false cases if they make an attempt to meet their children.

Errant and vindictive mothers are often successful in getting custody of their children, courtesy staunchly feminist nymphomaniac mindset of the judiciary giving in to crocodile tears and false show of motherhood in courts. This deprives two individuals of their rights, the child and the father. A child is deprived of a father’s love, affection and care and the father is forced to strangulate his fatherhood. The society and the judiciary need to be sensitized about the importance of the presence of both the parents for a child’s normal upbringing and in the best interest of the child’s future. USA has shown us the catastrophic effects of creating Fatherless Children and Childless Fathers. Teenage Pregnancy, Alcohol addiction in adolescence, high inclination to crimes and many other ill  effects have come to forth in the American Society, courtesy feminism taking its toll with its anti men policy. With draconian laws favoring women irrespective of merits in Indian legal scenario, Indian society is moving at dramatic pace towards self extinction.

CRISP (Child Rights Initiative for Shared Parenting) an initiative taken under the aegis of Save Indian Family Foundation (SIFF) has made its mission to voice the cries of innocent sufferers and sensitize the society about the dire need of both the parents and especially a father in a childs life.

Announcing its launch on 14th June 2008 at Gandhi Statue on MG Road, near Cubbon Park, CRISP invites people to participate in this noble cause and make an attempt to save the society from a potential and impending catastrophe.

Non-Bailable Warrant against IIT Grad’s Wife

New Delhi, 28th May, 2008: In an interesting development, Rohini Metroplitan Magistrate issued the Non-Bailable Warrant against the dishonest wife who failed to appear on last couple of dates. Jaspreet Kaur, wife of IIT alumunus Prameet S Narula was being summoned for the proceedings against her u/s 182 IPC initiated by Punjabi Bagh Police.

In this matter, Punjabi Bagh Police had filed a Kalandhra u/s 195 Cr.P.C in the Court of Metropolitan Magistrate, Rohini Court in August 2007. Metropolitan Magistrate had taken the cognizance u/s 182 IPC and had been repeatedly summoning the accused Jaspreet Kaur who is presently residing in Melbourne, Australia. On the last date of hearing in Feb, 2008, accused father Jaswinder Singh residing in India was asked by the Hon’ble Court to produce the accused on next Date Of Hearing (28th May); failing which non-bailable warrant were issued by the Metroplitan Magistrate on 28th May. “The warrants to be served by the Ministry of External affairs”, the Magistrate added.
While placing the matter before the court, Punjabi Bagh Police highlighted the complaint dated 5th may, 2004 filed by Ms. Kaur against Mr. Narula alleging that the later had destroyed her passport. This complaint was filed by Ms. Kaur on 5th May, 2004.

However, in an affidavit submitted by her in an Australian Court she submitted the true copy of her passport which was issued in 2000. The same was highlighted by Mr. Narula to the Punjabi Bagh Police in May, 2007, acting upon which police submitted the Kalandera u/s 182 IPC in the Court of Metropolitan Magistrate in August, 2007. As an evidence, the copy of her passport was attached on which she had traveled to Australia in July, 2006 which carries the stamp of Australian Visa. 182 IPC deals with giving false information to the public servant in order to cause injury to someone. Maximum punishment for the offence is prescribed as 6 months of RI.

Ms. Jaspreet Kaur has also initiated another criminal proceedings against Mr. Narula, pending the court of ASJ, Rohini Courts. However after filing the case, Ms.Kaur left for Australia without even intimating the court and leaving Mr. Narula with an agony to face criminal proceedings for last four years. Ms. Kaur then in Australia filed the divorce for the fourth time (her earlier applications of divorce were either dismissed or withdrawn by herself). But here Ms. Kaur committed a mistake when she moved a true copy of her passport carrying her Australian Visa in the Australian Court. The same was produced by Mr. Narula in front of Punjabi Bagh Police.

It seems Mr. Narula’s long and patient wait for justice for last four years is finally getting paid off. This should be a lesson to all those who believe that they will manipulate the law to their benefit and still go scot free.

Awareness program in front of Family court - Mumbai

Protect Indian Family Foundation(PIFF) , NGO, Mumbai is conducting an awareness program- ‘Effects of 498a, Dowry Act & Domestic Violence Act on Indian Families’.

We will gather in front of Family court and distribute pamphlets, this pamphlet will outline the irreversible ill effects of the family breaker laws like IPC 498a, DV Act(PWDVA), Dowry Prohibition Act, etc.. All the members are requested to wear the PIF T-shirt which will be available near the venue, or at our Mulund office in advance.

Gifts to babies not dowry: SC

New Delhi, May 19: Gifts for a newborn, demanded by a woman’s husband and his family, cannot be regarded as dowry, the Supreme Court has ruled.

The court acquitted Narayanamurthy from Karnataka whose wife committed suicide over alleged demands for such gifts.

The woman, Jagadeshwari, set herself ablaze in her husband’s house on November 11, 1990, after alleged harassment by him and her in-laws for failing to get enough dowry.

After a daughter was born to Jagadeshwari, her in-laws had demanded a gold ring and silverware for the thread-changing ceremony that was to be held in the child’s maternal home.

But Jagadeshwari’s family could not gift the gold ring, following which Narayanamurthy refused to participate in the ceremony and went back to his house.

According to the prosecution, Jagadeshwari was being harassed from day one of her marriage in 1989 for bringing insufficient dowry. She had got Rs 4,000 in cash and five gold ornaments from her family.

Jagadeshwari stayed with her parents for five months during her pregnancy and gave birth to the girl there.

A few days after the thread-changing ceremony, Jagadeshwari’s brother Ravichandra took her and the child back to Narayanamurthy’s house and assured her in-laws that their demands would be met in a short time. They, however, continued to harass Jagadeshwari, the prosecution said.

About a week before killing herself, Jagadeshwari went back to her parents’ house and told them she had been assaulted. But her parents persuaded her to go back to Narayanamurthy.

Jagadeshwari’s in-laws — Kannappa and Shivabhushanamma — and Narayanamurthy were tried under sections 498A (cruelty) and 304B (dowry death within seven years of marriage) of the IPC and sections 3, 4 and 6 of the Dowry Prohibition Act, 1961. Father-in-law Kannappa died while trial was on.

The trial court acquitted Narayanamurthy and his mother in April 2000 for lack of evidence.

On appeal by the state, Karnataka High Court convicted the husband under Sections 498A and 304B of the IPC and sentenced him to seven years’ rigorous imprisonment.

He was also sentenced to another two years’ rigorous imprisonment under Section 498A of the IPC and fined Rs 5,000.

The high court, however, acquitted him of offences under Sections 3, 4 and 6 of the dowry prohibition act. It also upheld Shivabhushanamma’s acquittal.

The apex court, which acquitted Narayanamurthy, too, said though it had been proven that Jagadeshwari’s father had gifted the silverware to Narayanamurthy at the ceremony, “such gifts are not enveloped within the ambit of dowry”.

“We agree with the high court that the evidence against the mother is insufficient and inconsistent to convict her,” it said.

The court said, even otherwise, “mere evidence of cruelty and harassment” does not make a case under Section 304B of the IPC (dowry death within seven years of marriage).
